Terms of Service

    By creating an account or using AutoNex, you agree to these Terms. Please read them, they cover your subscription, what you can and cannot do with the service, and how disputes are resolved.
  

1. The Service

AutoNex provides an AI-powered WhatsApp automation platform that helps local businesses manage customer conversations, bookings, and FAQs via the WhatsApp Business API. We provide the software; you are responsible for how you use it with your customers.

2. Eligibility and Account

You must be 18 or older and authorized to enter contracts on behalf of the business you register.
You are responsible for all activity under your account. Keep your credentials secure.
One account per business. Creating multiple accounts to circumvent plan limits is prohibited.
You must provide accurate business information during registration and keep it up to date.

3. Subscriptions and Billing

Free trial: New accounts receive a 14-day free trial. No credit card is required to start.

Paid plans: After your trial, continued access requires an active subscription (Starter, Pro, or Scale). Prices are in Saudi Riyals (SAR) and include VAT.

Billing: Payments are processed by Moyasar, a Saudi-certified payment gateway. Monthly subscriptions renew every 30 days; annual subscriptions renew every 365 days from the activation date.

Cancellation: You may cancel at any time from the Billing page. Your subscription remains active until the end of the current billing period, no partial refunds are issued for unused days.

Price changes: We will give you at least 30 days' notice before changing subscription prices. Continued use after the effective date constitutes acceptance.

4. Acceptable Use

You agree to use AutoNex only for lawful business purposes. You must not:

Send unsolicited bulk messages (spam) to customers who have not opted in
Use the AI to mislead, defraud, or deceive customers
Violate Meta's WhatsApp Business Platform Terms of Service or Policies
Attempt to reverse-engineer, scrape, or resell access to the platform
Use the service to store or transmit illegal content under Saudi law
Circumvent rate limits, conversation quotas, or security measures

Violation of these terms may result in immediate account suspension without refund.

5. WhatsApp and Meta

AutoNex operates through Meta's WhatsApp Business API. Your use of AutoNex is subject to Meta's Business Terms of Service and WhatsApp's Commerce Policy. You are responsible for obtaining and maintaining your own WhatsApp Business API access, phone number, and compliance with Meta's messaging policies.

6. Data and Privacy

Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms. By using AutoNex, you acknowledge that:

You have a lawful basis to process your customers' WhatsApp messages through our platform
You will inform your customers that an AI assistant handles initial inquiries on your behalf
You are the data controller for your customer data; AutoNex acts as a data processor

7. AI Limitations and Liability

AutoNex uses large language models to generate replies. While we work hard to make the AI accurate, it can make mistakes. You acknowledge that:

You are responsible for reviewing and correcting AI-generated responses before they are sent (if using draft mode)
AutoNex is not liable for incorrect information provided by the AI to your customers
You should configure escalation rules to route sensitive or complex queries to a human

8. Uptime and Service Level

We target 99.5% monthly uptime for the core messaging and booking features. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for downtime caused by Meta's WhatsApp API, third-party integrations, or force majeure events.

9. Intellectual Property

AutoNex retains all rights to the platform, software, and AI models. You retain ownership of your business data and customer conversations. By using AutoNex, you grant us a limited license to process your data solely to provide the service.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. Upon termination:

Your access to the dashboard is immediately revoked.
Your data is retained for 90 days, during which you may request an export.
After 90 days, all customer and conversation data is permanently deleted.

11. Limitation of Liability

To the maximum extent permitted by Saudi law, AutoNex's total liability for any claim arising from these Terms is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost revenue or customer data.

12. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be resolved in the competent courts of Riyadh, KSA.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of AutoNex after the effective date constitutes acceptance of the revised Terms.
